Terms of Service

1. Agreement to Terms

By accessing or using ClubDeck ("the Service"), operated by ClubDeck (jlehtimaki.fi), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including administrators, coaches, players, and guardians.

2. Description of Service

ClubDeck is a sports club management platform that provides tools for team management, scheduling, availability tracking, lineup building, billing, and communication. The Service is provided as a hosted web application.

3. Account Terms

To use the Service, you must create an account. You agree to:

• Provide accurate and complete registration information.
• Maintain the security of your account credentials.
• Promptly notify us of any unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

You must be at least 16 years old to create an account. Guardian accounts may be created by parents or legal guardians for users under 16.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Infringe on the rights of others, including intellectual property rights.
• Upload or transmit harmful, offensive, or illegal content.
• Attempt to gain unauthorized access to any part of the Service or its systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service for any purpose other than sports club management.
• Scrape, harvest, or collect data from the Service without permission.

5. User Content

You retain ownership of content you upload to the Service ("User Content"). By uploading User Content, you grant ClubDeck a non-exclusive, worldwide license to use, store, and process that content solely for the purpose of operating and improving the Service.

You are responsible for ensuring that your User Content does not violate any applicable laws or infringe on any third-party rights.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you consent to the practices described in the Privacy Policy.

7. Billing and Payments

The Service is currently offered free of charge during the beta period. If paid plans are introduced in the future:

• You will be notified of pricing changes in advance.
• Payment processing is handled by Stripe. By making a payment, you also agree to Stripe's Terms of Service.
• Billing-related features within ClubDeck (invoicing, membership fees) are tools for club administrators to manage their own billing. ClubDeck is not a party to transactions between clubs and their members.

8. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

9. Termination

You may terminate your account at any time by contacting us at support@clubdeck.jlehtimaki.fi.

We may suspend or terminate your account if you violate these Terms or if continued use poses a risk to the Service or other users. We will make reasonable efforts to notify you before termination, except in cases of serious violations.

Upon termination, your right to use the Service ceases immediately. We will retain your data for a reasonable period to allow you to request an export, after which it will be deleted in accordance with our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
• ClubDeck shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or 100 EUR, whichever is greater.

11. Indemnification

You agree to indemnify and hold ClubDeck harmless from any claims, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of Finland. Any disputes arising from these Terms or the Service shall be resolved in the courts of Finland.
